YTB Settles the Attorney General Lawsuit in California

YTB settled the lawsuit filed by California authorities against the embattled multilevel travel marketing company and its key executives. The company will pay $1 million in penalties, costs, and restitution, and it must register with the state of California as a franchise business.

In addition, YTB agreed to new operating procedures such as eliminating the requirement for affiliate agents to buy a Web site ($450 upfront plus $50 a month in ongoing fees) to start their travel businesses and limiting how much recruiting agents can earn on the revenues of the agents they sign up in turn. The company must also stop issuing travel credentials in California, change its marketing materials that promise travel discounts and perks for its agents, and make other major changes in its business practices.

YTB Claims "Tentative" Agreement in California Suit

An article published with Travel Pulse states YTB has claimed that there has been a tentative agreement regarding the suit that was filed against them last year. In August, California Attorney General Edmund G. Brown Jr. announced a lawsuit against YourTravelBiz.com for operating what Brown called a “gigantic pyramid scheme” that recruited tens of thousands of members with claims that members could earn huge sums of money through its online travel agencies. YTB sees Q3 profit fall 87%

Internet travel service company YTB International Inc. said Monday that its profit plummeted nearly 87 percent while total revenue grew 7.5 percent.

The company reported net income of $287,999 for the third quarter ended Sept. 30, compared to net income of more than $2.1 million in last year’s quarter.

YTB said its net revenue grew 7.5 percent in the recent quarter to $42.9 million compared to $39.9 million in the third quarter of last year.

The company said that revenue from travel commissions and services for this year’s third quarter rose 45 percent to $8 million compared to the same period last year.

For the nine months ended Sept. 30, 2008, the company reported a net loss of $3.4 million on revenue that grew 36 percent to $130 million.

“While we are disappointed by the reduction in our net income, we are also aware that much of the softness we are seeing is reflective of both an industry-wide trend and a difficult comparison to last year’s explosive growth,” Scott Tomer, chief executive of YTB, said in a statement. He said YTB has maintained a strong marketing presence, and invested in the resources and infrastructure necessary to ensure the continued success of the business.

YTB is selling an Edwardsville, Ill., office building and some furniture and equipment for $1.5 million to Prestige Management Services, according to a regulatory filing last week.

(OTCBB: YTBLA) provides Internet-based travel booking services for travel agencies and home-based independent representatives in the United States, Puerto Rico, the Bahamas and the U.S. Virgin Islands. Florida State Senator Burt Saunders linked to controversial online travel company makes news headlines. The Senator serves on the Board of YTB International, which operates YourTravelBiz.com, commonly known as YTB. The company is being sued by the State of California as well as other individuals. The Senator would not make any commnent regarding his relationship with YTB.

With all the controversy surrounding YTB so many members are going to be looking for a way to continue with booking travel. Royal Carribbian and Celibrity Cruises still refuse to accept any bbokings in dealing with YTB who is now considering becoming a franchise sometime in the beginning of 2009. Instead of booking travel they will be more like a WalMart instead of a travel company. Why would anyone want to pay $500 to beoome a member of YTB when you can go directly to WalMart's website? YTB Contemplates Franchise

Yes it is true that Your Travel Business is contemplating implementation of YTB into Franchises which has been a provider of Internet based travel booking services for travel agencies and home-based independent referring travel agents. What does this mean to all those referring travel agents who have recently joined with YTB and those who are building a team?

If a franchising model is adopted who will actually own YTB or will they lose even more control of where their company is heading? I always believed that paying the $500 investment allowed a person to own their own company and be able to make commission on the travel booked or when friends booked from the website. YTB is becoming more like an e-commerce site than a travel business with the network marketing aspect. If a franchising model is adopted, its distribution is expected to be managed by subsidiary and current marketing arm of the Company, YourTravelBiz.com, also known as YTB.com.

It may be true that the iFranchise Group has decades of experience developing and implementing efforts with clients such as Blockbuster, Ace Hardware and McDonalds but none of these companies had network marketing implemented into their company process previously.

The change to franchising is going to affect so many YTB referring travel agents who joined for the travel benefits of being an independent travel consultant. They have already implemented flowers, cars, and other things on their website and getting further away from the travel industry which is where they began. You can go to Walmart or Target to get some of the same deals or better with the products they are offering.

Illinois launches probe into YTB International travel company

The pressure built Thursday on a Wood River-based travel company, even as thousands of its members gathered in St. Louis for a festive annual convention.

The Illinois Attorney General's Office said it has launched a probe into YTB International, which the top lawman in California earlier this week called "a gigantic pyramid scheme."

And the local chapter of the Better Business Bureau issued a report detailing complaints it has heard of misleading offers made by the company's sales reps.

The company has denied any wrongdoing.

The Illinois and Better Business Bureau probes are the latest signs of deeper scrutiny of the fast-growing company, which sells cruises, flights and online travel agencies — websites through which people can earn commissions selling cruises and flights — for $450 up front and $50 a month.

By the end of March, YTB had sold 139,000 of these agencies and had more than 340,000 sales reps, who pay nothing but earn a commission for each agent they sign up.

But few of those agents make money selling travel. Four out of five earned $39 or less last year, according to California Attorney General Jerry Brown, and 80 percent of the company's revenue comes from selling new agencies, not travel sales.

That, plus marketing campaigns which some say are misleading, led Brown to call the YTB a pyramid scheme and file a lawsuit seeking $25 million in damages.

Now Illinois is on the case as well."

We have an open investigation," said Natalie Bauer, a spokeswoman for Attorney General Lisa Madigan. "We are in the process of contacting the California attorney general's office about their findings."

Bauer would not say when the Illinois probe began, but said it has been open for "a while." Her office has received 70 complaints about YTB since 2002.

Missouri Attorney General Jay Nixon does not have an active investigation, said spokesman Scott Holste, and has received just a handful of complaints.

The Better Business Bureau of Eastern Missouri and Southern Illinois also has been digging into YTB, said president Michelle Corey. It has received 90 complaints in the last three years, 40 in 2008, typically from people trying to get a refund of their $449 joining fee."

For the most part, people are telling us they felt deceived by the company, primarily about their potential earnings," she said. "After getting involved in the program, paying up front and receiving their packet of information, what they received was different than what they were promised."

They also said YTB has an "unsatisfactory record" with the BBB due to "unresolved issues."

In a statement, company officials said they were unaware of any unresolved complaints with the Bureau and said they'll fight the California lawsuit."

We are proud of our business model and how our operations are conducted in an ethical and transparent way," said chief executive Scott Tomer. "We also are wholly confident that our business model will withstand scrutiny, and look forward to setting the record straight in court."

At the convention, which runs through Saturday and is expected to draw 20,000 people to the America's Center, YTB reps said the complaints are misguided: Sour grapes from people who didn't put in the time it takes to succeed.

That's how Craig Smith sees it. The Houston resident joined YTB eight months ago and said he now earns more selling travel and signing up sales reps than he did in his old full-time job in telecommunications. YTB's product, he said, comes exactly as advertised."

The websites work. They do what they're supposed to do. There's no scam in me selling you what it is that you said you wanted," Smith said. "If you don't go out and do anything with it, and you spent $500, how is that a scam?"

Amazinging people are still inquiring about YTB wondering if everything I have written in my post is truth or fiction. Just today a young man contacted me asking why I put this information out on the Internet for others to read. If you take the time to really read the content and click the link(s) you will see that nothing here is anything which I composed. I have no reason to fabricate anything and think it is sad that newcomers don't take the time and do their due dilligence to explore and research before getting involved.

Spending $500 to join any company is quite a bit of money especially if the person has to borrow from Peter to pay Paul. Personally I would be happy to come across information that is placed here to allow me to make an educated decision on if I want to join YTB. I have some great team members who were once in YTB that know what I put out is the truth. It would be wise for any and everyone who is interested to do inquiries about YTB prior to joining and become enlightened first.

Parents Victimized in Another YTB Scam

Seems it just doesn't stop as another group of parents this time, get vicitimized in another YTB Scam. Students were making plans to take a cruise as their graduation gift to themselves after years of finally being able to finish high school. The students parents were making payment to a woman who is a referring travel agent with the notorious YTB who alledgedlly took their money. This story was written and reported by Jennifer Johnson where the incident took place in LaVergne, Tennessee. One of the parents speaks out about the money that was lost initially thinking the trip was being sponsored by the school only to find out later it wasn't. Ms Cynthia Anderson, a referring travel agent with YTB appears to have scammed quite a few other high schools in the area and the student will not be taking their high school dream trip afterall.

Another YTB Agent Scams Bus Drivers in Houston

A recent article dated March 22, 2008, written by By Elizabeth Scarborough talks about Bus Drivers Scammed Out Of Trip by another YTB referring travel agent.

Ruby Bell and Josephine Alix thought they would be taking a trip during spring break with other fellow Houston bus drivers but instead they never made it. Ms Bell planned to take her mom to celebrate her 65th birthday but their plans were ruined by a woman named Tonya Covington in YTB. They tried to reach this woman only to receive her voice mail with no return phone calls and their money taken by another YTB travel agent.

It's very unfortunate that those involved in YTB claiming to be travel agents scam so many people only to take their money while their reps continue recruiting innocent people to join their company for $500. It is so sad there are so many unethical people who make it bad for others who are serious about their businesses.

In response to the e-mail recently circulated to some of our Directors from Ted Lindauer, YTB makes this initial statement. Mr. Lindauer was engaged by YTB as legal counsel for several years and has been a friend of Coach's for decades. Mr. Lindauer submitted a written resignation to YTB on August 10, 2007. Although Mr. Lindauer's arrangement with YTB did not provide for compensation in the event of his resignation, Mr. Lindauer made several arbitrary and unreasonable demands on the company.After months of attempting to work with Mr. Lindauer in good faith to arrive at a generous settlement providing for more than he was entitled to under the terms of his engagement, YTB is shocked to now learn that its own former counsel has attempted to alarm the YTB community with this confusing and unwelcome e-mail communication. We are disappointed that Mr. Lindauer has apparently chosen to cease negotiations and pursue another agenda seeking to harm his former client and its business family.This situation is being evaluated by our legal team and appropriate action will be taken immediately.

I resigned from YTB in April, 2007 because YTB was ignoring my compliance recommendations and refusing to provide staffing to support my administrative responsibilities. Coach asked me to withdraw my resignation and promised to address my compliance recommendations and to provide the needed staffing. I accepted Coach at his word and withdrew my resignation. In the following months my administrative department received additional personnel, including the appointment of CFO John Clagg’s wife, Andrea, a non-attorney, as the Director of Legal Services. My compliance recommendations continued to be ignored.

In early August, 2007 I learned that John Clagg was giving various compliance directives to his wife. Neither John nor his wife were discussing these matters with me before acting on them. I objected noting to Coach that neither John Clagg nor his wife were qualified to make legal compliance decisions and the decisions they had made were wrong ones. Coach refused to stop the Claggs from making compliance decisions and refused to reverse the erroneous compliance decisions they had made. On August 10th I resigned and submitted my request for severance.

Andy Cauthen, who was then CEO of Your Travel Biz.com, and Coach both asked me to once again withdraw my resignation. Coach promised to address my concerns after the August Convention in St. Louis. He also promised a generous severance package when I retired from YTB. I again withdrew my resignation and returned to work at YTB.

After the Convention Coach informed me that local attorney John Simmons was being engaged as overall General Counsel for YTB International, Inc. and its subsidiaries. I met with John Simmons on several occasions in August to review my compliance and other recommendations previously provided to Coach in several memos. On September 7, 2007, John Simmons asked me to temporarily vacate my office at YTB so it could be modified to house two attorneys. That evening I received an email from John Simmons welcoming me to his new legal team.

Several days later, while working at home, I received an email from Thad Leach, a local attorney who is part of the new legal team. Mr. Leach’s email contained one sentence and stated that YTB had decided that it was no longer in need of my services.

I immediately asked for and was granted an appointment with Coach and Scott. On the day of the appointment I received a call cancelling the appointment and telling me to contact Thad Leach. Mr. Leach and I exchanged various emails about my severance with Mr. Leach denying that YTB owed any severance to me despite the fact my written agreement with YTB called for a specific severance package.

In October YTB offered me a new 3-year consulting agreement in lieu of my pursuing my claim for severance. I agreed in principle subject to having an acceptable written agreement. Mr. Leach sent a proposed draft of a new agreement which was one-sided and allowed YTB to cancel the agreement at any time with no further obligation to me. I rejected this draft and proposed seven changes. Mr. Leach dragged the matter out for several months, finally saying he needed to speak with Coach. I never received a response from YTB as to the seven changes I requested. Mr. Leach notified me just before Christmas that there had been unspecified “new developments” and he would be back in contact with me “after the holidays.”

Continuously throughout the months following September 7, 2007 I offered to train the new legal team in MLM legal compliance requirements in 12 two-hour training seminars without any compensation to me and whether or not I was able to settle my severance claim or enter into a new agreement. Mr. Leach rejected my training proposal at first, then refused to respond as I renewed my offer over and over again.

Most disappointing of all was the refusal of Coach, despite my repeated requests and then demands, to let the YTB Reps and RTAs know that as of September 7, 2007, I was no longer affiliated with YTB and to tell them who is overseeing YTB’s marketing legal compliances. If Coach is comfortable having a team of local attorneys with no Multi Level Marketing experience take on the responsibility of keeping YTB in legal compliance, why hide them and pretend that I was still at YTB?

So how do you choose the company that is the right fit for you? In the January 2008 "Success from Home" magazine that features YTB, Direct Selling Association (DSA) outlines what to look for.

Is this really true or just another page created by someone in YTB? In reading an article someone in the company put out they talk about bashing other companies, but as much as they say they don't, they do. True, it's not about bashing but it is about factual information which should be provided when anyone is contemplating IF they want to become part of any network marketing company.

It is sad what has happened with YTB but none of the things you read here are fictional or made up nor a page created by someone in the company I represent to show discredit. What is really sad is how members continue recruiting without providing the facts. I would personally want to be part of an organization who does not NEED to place themselves on the stock market and who is financially debt free with heavy duty financial backers. Due your homework and get the facts before you join with any company because it is your investment and your life. Travel parties don't make a company but it's the compensation plan that really matters.

PERILLO TOURS no longer is accepting bookings from agents affiliated with YTB Travel Network, a multilevel marketing travel agency. Steve Perillo, president of Perillo Tours, said that when he read a few weeks ago that Royal Caribbean was weeding out "card mills" and that YTB was on the list, he decided to have a look at YTB bookings for his firm. He said he found that "90% of the travelers and booking agents were the same person." He said Perillo Tours might take similar steps regarding similar companies. Meanwhile, IATA said it canceled accreditation of four U.S. travel agencies for violating accreditation standards forbidding the "improper lending, subcontracting or hiring to a third party of an IATA numeric code by agencies." It is apparent that agencies in the card mill/multilevel marketing categories are among the targets, but IATA declined to name the canceled companies.

It appears to be a spiral effect with YTB losing their ability to book travel anywhere these days. Agents who depend on this company for their survival are really in trouble as other agencies refuse to do business with them.

With the holiday seasons quickly approaching I would like to extent the invitation for anyone in YTB to get positioned before it is too late to become a part of our TraVerus family.

Important YTB Update - IATA, IATAN Credentials

The International Air Transport Association (IATA) and the American Society of Travel Agents (ASTA) have both just announced that they will no longer recognize YTB as a travel company. In short, YTB reps will no longer be eligible for courtesy discounts when they travel using their now defunct IATA YTB cards, nor will they be able to book travel with the major cruise lines like Royal Caribbean Cruise Line/Celebrity. These incredibly unfortunate circumstances that have recently befallen YTB follow the announcement that 21 of the top 28 income earners with YTB have lost as much as 40% of their monthly income during the last 6 months and this substantial income loss occurred before the announcement from IATA and ASTA within the last 48 hours!

Today I am even more convinced that I made the right move not to go with YTB but Traverus instead, and I have quite a few people on my team who were in YTB but swithced to Traverus. YTB was Terminated from Royal Caribbean as a Card Mill. Now it is reported they have Lost thier IATAN accredidation. This means that the YTB business model is losing to much credibility with the Travel Industry and suppliers. I have tried my best to EDUCATE people on the difference between an RTA or CRTA vs a TRUE Certified Travel Agent. I have nothing against any agents as I still have friends over there whom I am sure will be joining Traverus now. Why? Because Traverus is Different...

IATAN also dropped three other companys. Joystar did not loose thier IATAN numbers to date just thier Royal Caribbean Cruise Liscense with YTB and GTI.
